An important source of foreclosure help is the company that collects your monthly payments and is in charge of your mortgage called a servicer. Most people think of the servicer as an adversary that wants to remove them from their home. In general though, servicers are supposed to work with you to keep the property if you have the financial ability to pay.

From your servicer’s perspective, if you abandon your property, or the servicer forecloses on you, the servicer will most likely lose a substantially greater amount than working with you to keep the property. You can contact the servicer before you are late on your payments, or after you are late. The amount of foreclosure help the servicer offers depends on your servicer and your particular case.

For foreclosure help one of the first you things you should do is contact your servicer to see if they will work with you to keep your property. If you are late on payments because of a temporary hardship or long term hardship, the servicer often will work with you to establish a payment plan to repay your late payments. Additionally, the servicer can sometimes offer rate adjustments, such as switching your adjustable rate mortgage (or ARM) to a fixed rate mortgage, or lowering the interest rate you pay. The servicer can provide foreclosure help by stalling foreclosure while you work with them on payment plans.

If you no longer desire own the property, the servicer can also let you sell your property for less than you owe them and they write off the difference. This is called a short sale. This will sometimes let you get out of a property you do not want without having to endure the hassles of foreclosure. Once again, the servicer will be willing to provide you with this foreclosure help because it saves them money in the long run.

As stated, the amount of foreclosure help provided by the servicer depends on your income and if you desire to keep the property.

Another way the servicer can provide foreclosure help is through a short sale. In a short sale your mortgage company accepts less than what you owe on the house and writes off the difference.

In this scenario you the borrower will have to work with your mortgage company to get them to accept the sale. Usually, a potential buyer will come to your house and have an interior price evaluation performed. The information will be presented to the mortgage company and it will either accept or deny the offer.

In order to get the servicer to provide foreclosure help and to accept this you will have to contact the servicer yourself and work to accept the sale. You usually will have to provide proof of hardship and unwillingness to keep the property. A great source of foreclosure help maybe a potential buyer who has been through the short sale process before since they will know better how to work with the mortgage company.

Foreclosure help - Paulson Plan

The Paulson plan – How can it help you?
One piece of foreclosure help that the government has been touting is the Paulson plan. The Paulson plan attempts to aid borrowers by introducing a temporary interest rate freeze on adjustable rate mortgages. However, the Paulson plan provides foreclosure help only for certain individuals. The plan will help homeowners who took out adjustable rate mortgages (ARM) between 1/1/2005, and 1/31/2007, whose rates are not scheduled to reset between 1/1/2008 and 12/31/2010. For eligible borrowers, the plan would freeze the five-year rate at the lower rate the borrower now has.

However, the plan does not provide foreclosure help to borrowers who can continue to make payments if their adjustable rate mortgage resets. The plan also does not provide foreclosure help to those who cannot make payments if their ARM resets, and those who cannot afford to make their current mortgage.

Why does this matter you ask? If the borrower already needs foreclosure help because they are late on payments, the plan does not provide help to them. This means that those who are in need of real help for forestalling foreclosure, the plan does not help them. The foreclosure help is only provide to those who are current on payments.

Additionally, the plan does not help people who are deemed able to make their payments under the new rates. This means there is no foreclosure help for those who will suffer from higher rates, but can technically still afford it.

The plan also does not provide help to investors. It only provides foreclosure help to borrowers when the property is their primary home. If the property was bought speculatively, or to flip, the plan doesn’t provide any foreclosure help.

However, even if you do not qualify under the Paulson plan for foreclosure help , you can always try to contact your servicer for additional foreclosure help.

A borrower who is going to be late on payments, or is late on payments, can seek foreclosure help by contacting their mortgage servicer. The mortgage servicer can often provide options to the borrower such a payment plan, a loan modification, or an interest rate adjustment. This being said, the borrowers should know the applicable foreclosure law in order to protect themselves. The borrower should know how long the foreclosure time in their state is, and what laws the mortgage company must abide by.

Foreclosure help can also be provided to borrower’s by knowing the foreclosure laws of the state their property is in. Each state has different foreclosure laws, and foreclosure lengths. The foreclosure laws tell when the mortgage company can foreclose on a property. These laws vary if the foreclosure is decided by a judge or not, if the state has a redemption period, or the type of property that is owned.

Whether or not a foreclosure is judicial (decided by a judge) or non judicial varies state by state and sometimes within states themselves. Borrowers should inform themselves of their state and the situation they would be in. This information will be very important when contacting the servicer for foreclosure help.

A redemption period provides foreclosure help by providing a time in which the borrower can repay the total debt owed for the property, and retake possession of the property. Not all states have a redemption period, and the time of the redemption period depends on state to state.

The foreclosure laws also depend on the type of property. In some states, there are different foreclosure times depending on if the property is farmland, in a rural area, or the size of the property.

By knowing the foreclosure laws for the state they are in, borrowers can protect themselves when seeking foreclosure help from the mortgage company.

A Deed in Lieu can provide foreclosure help by sparing you the foreclosure process.

What is a Deed in Lieu?

A Deed in Lieu provides foreclosure help by allowing you the borrower to avoid the stigma of having your property foreclosed upon. With a deed in lieu, the borrower transfers the title of the property to the mortgage servicer in exchange for the servicer forgoing foreclosure.

Why could a Deed in Lieu be good for you?

You would receive foreclosure help by avoiding having your property foreclosed upon and you can sometimes receive additional foreclosure help since mortgage servicer will sometimes provide additional incentive for vacating the property.

Why is a Deed in Lieu good for your mortgage company?

A Deed in Lieu saves the mortgage company time and money. The mortgage servicer does not have to go through a lengthy foreclosure time and a lengthy eviction to get you to leave the property saving them money.
